That depends. Use of an entire poem is not fair use, in general. So, either the work is in the public domain or you need permission. To determine if the copyright has expired (putting the work in the public domain) is a little complicated.

If the author died more than 70 years ago, and the author held the rights, the work is in the public domain, unless you're looking at a translation.

If the author died less than 70 years ago, and the work was published in the US, the rights have probably not expired (you could check the Library of Congress/Copyright Office database). You need to find their owner, and seek permission.

If the work was published elsewhere, you're going to need to find out how that country's laws work.

If the author is still alive, the rights are almost certainly still controlled by either the publisher or the author. And you need permission.

If I want to use a poem as a tagline for my small floral company and give credit, am I covered? I'm not finding any helpful sites yet so figured I would ask.

Thank you for the kind words.

It's funny, because I'm generally pretty confident, but I find writing for an audience that does it well, or that judges words for a living, to be quite intimidating. That means that a compliment on my writing has the power to make my week, not just my day.

Great, great post. Writer, lawyer or no, you make a lot of sense (and let's face it, it doesn't take qualifications to know what stealing is!).
